Durable Power of Attorney

The Statutory Durable Power of Attorney allows you to designate someone to make financial decisions for you in the event that you are unable to do so for yourself. It may be used immediately, and is effective until it is revoked by you, or until your death. The agent appointed by a durable power of attorney has the power to conduct your business, including activities such as buying or selling real estate, managing property, conducting banking transactions, investing money, making legal claims and conducting litigation, and attending to tax and retirement matters, unless you have specifically restricted that authority.

The biggest reason for creating powers of attorney is to avoid the necessity for a court-ordered guardianship in the event that you suddenly become incapacitated.
